I.  Purpose

A. 本学术不端行为指控程序暂行办法(“程序”)是为了执行最全菠菜网院(“学院”)董事会的学术诚信政策(“政策”)和解决学术不端行为指控程序而制定的.

B. As defined in the Resolving Academic Misconduct Allegations, 协调员将进行初步调查并审议临时措施. 如果协调员认为临时措施是适当的, 协调员将根据本程序实施临时措施.

II.  Scope and Applicability

A. 本程序适用于学术不端行为指控的答辩人.

B. 本程序不适用于非学术行为不端或学生申诉, 哪些问题将根据适用的政策和程序进行调查和解决.

III.  Definitions

A. 本程序中所有大写术语的含义与政策或解决学术不端指控程序中规定的含义相同.

IV.  Interim Measures

A. Interim Measures may include, but are not limited to:

1. 暂时暂停应诉人的职务,等待有关指控的结果;

2. Prohibiting access, in person or electronically, 通过与信息与教学技术联系,获取课堂或大学信息技术资源;

3. Issuing mutual no contact orders, 包括但不限于可能阻止面对面的限制, telephonic, electronic and/or third-party communications or contact;

4. 采取其他合理措施,以确保所有参与调查的人士的安全,以及书院的学习环境和运作的正常运作.

B. Issuance of Interim Measures

1. During the Preliminary Inquiry, the Coordinator may consider whether Interim Measures should be imposed to ensure the safety of any person or the College community; protect the College’s information technology resources; protect the integrity of the Investigation; or prevent actions that may impede normal College operations.

2. 如果协调员在初步调查期间确定临时措施是适当的, 协调员将在通知中列入临时措施. 

3. If prohibiting access is part of the Interim Measures, 协调者将指定被投诉人将被禁止访问哪些类和资源, based on the allegations.

4. 如果协调员在发出通知后认为临时措施是适当的, 协调员将以书面形式向被投诉人发出临时措施通知.

5. 协调员将尽合理努力,确保在调查和确定指控期间,任何临时措施的实施对被投诉人的不利影响最小, 包括与被投诉人和教职员就被投诉人注册的任何课程进行合作,安排被投诉人通过其他方式或更改课程作业或评估提交课程作业或评估, as needed, 如果答辩人被认定不负责任,允许答辩人在该课程中获得分数.

V. Opportunity to Be Heard Regarding Interim Measures

A. 学院将给予答辩人就任何临时措施的发布发表意见的机会.

B. To contest the Interim Measures, the Respondent must submit a written objection to the AVPL, 包括被申请人认为暂行办法不适当的理由, 在临时措施通知发送至被申请人之日起五(5)个工作日内.

C. AVPL或其指定人可根据书面提交或由AVPL或其指定人自行决定作出决定, 可否以书面或邀请答辩人亲自出席会议的方式要求答辩人提供补充资料, by telephone, or through electronic means.  指定委员不得为书院代表或聆讯委员会成员.

1. During the meeting, AVPL或其指定人员可与被申请人讨论,被申请人的行为和周围情况是否合理地表明,被申请人继续出现在学院财产上,或进入学院的教室或信息技术资源,对任何人的安全构成威胁, the College community, College operations, College information technology resources, or the integrity of the Investigation.

2. AVPL或其指定人员不会讨论通知中指控的是非曲实.

D. AVPL或其指定人员可以书面要求发布临时办法的协调员提供信息.

E. AVPL或指定人员将考虑被投诉人和/或协调员提供的信息,并决定是否支持, modify, 或在收到被投诉人书面异议之日起五(5)个工作日内撤销《最全菠菜网》.  如果需要收集就临时措施作出决定所需的信息,AVPL或指定人员可以延长此截止日期.

F. AVPL或其指定人的决定是最终决定,不得上诉或申诉.

G. 如不包括在有关通知书所载指控的决定内, the Interim Measures will terminate when the Decision is issued.
